Fatal Truck Accidents in Texas

Statistics from 2020 show that over 510 people died as a result of fatal truck accidents in Texas. Regrettably, many of these accidents were completely preventable. Every year, we see innocent people die as a result of fatal accidents in our state. Some of the leading causes of fatal truck accidents we see include:

  • Driver fatigue
  • Speeding
  • Reckless driving
  • Improperly secured cargo
  • Bad weather conditions
  • Poorly maintained trucks

If another driver’s negligence has taken the life of your loved one, you may be able to file a wrongful death claim. Unfortunately, truck accidents are much more complex than typical vehicle collision cases. When it comes to commercial vehicle accidents, there are several parties who can be held liable.

If the truck driver was at fault for the accident, you may be able to file a wrongful death claim against the driver. If the driver was working for a trucking company at the time of the accident, you may also be able to file a claim against the company. To succeed in a wrongful death claim, you will need to show that the driver or company was negligent in some way and that this negligence led to your loved one’s death.

If the truck driver was not at fault for the accident, you may still be able to file a claim against the trucking company if it can be shown that the company was negligent in hiring or supervising the driver. For example, if the company knew that the driver had a history of DUI arrests but failed to take action, this could be considered negligence on the part of the company. It is important that you seek legal guidance right away to determine who is at fault for the accident and who you can take legal action against.
