Truck Accidents in Texas

Each year, thousands of people are hurt as a result of truck accidents that take place here in the state of Texas. In many cases, these accidents are a result of negligence. We see countless innocent people suffer debilitating injuries as a result of drivers who are drunk, distracted, or otherwise negligent while behind the wheel.

If you have been hurt as a result of a crash caused by a negligent driver, you may be able to file a legal claim against the responsible party. In order to prevail, you must be able to demonstrate that the driver was negligent. How all

To prove that the truck driver was negligent, you will need to show that he or she breached a duty of care owed to you. This means that the truck driver did something (or failed to do something) that a reasonably prudent person would not have done in the same situation. For example, if the truck driver was speeding or texting while driving, this could be considered negligence.

Once you have established that the truck driver was negligent, you will need to show that this negligence caused your injuries. This is called causation. In other words, but for the truck driver’s negligence, you would not have been injured.

If you can successfully prove all of these elements, then you may be able to recover compensatory damages from the truck driver or his or her insurance company. Compensatory damages are intended to reimburse you for your losses, such as medical bills and lost wages. You may also be able to recover punitive damages in some cases.
